PREAMBLE

Orders and shipping are carried out exclusively on the basis of the following terms and conditions. These terms and conditions come into effect as soon as a person has signed a contractual subscription and / or has confirmed a purchase and is thus referred to as a customer. This service applies to the website (hereinafter website). The following general terms and conditions are thematically structured on the current page and are accessible to customers as soon as the customer has confirmed an order and / or the registration of a subscription.

The general terms and conditions determine the rights and obligations of MyFeld and the customers (together the parties individually the party), with regard to the individual forms of contract offered on the website.

By confirming his order, the customer accepts the contractual provisions of the order as well as the entirety of the general terms and conditions.

These general terms and conditions, depending on the current version on this website, apply from the day of registration and are therefore subject to change.

1 PRESENTATION OF THE COMPANY

The website is edited by MyFeld.

2 LEGAL AND BUSINESS CAPABILITY

The customers declare that they are of legal age and have full legal capacity.

3 SCOPE OF APPLICATION

The products and the service are only available in Switzerland and Lichtenstein and via this website. Subscribers who live outside the area of ​​validity can only be considered with prior agreement.

4 SERVICE AREA

The website service is normally available to customers all year round, seven days a week and 24 hours a day, except in the event of a deliberate or unintentional interruption, particularly during maintenance work or force majeure. MyFeld cannot be prosecuted in this sense, taking into account the duty to act.

5 SUBSCRIPTION AND SHIPPING

The dispatch of the mature products consists of a maximum of two deliveries per calendar month. Delivery will be billed to the customer (not included in the subscription price). A delivery costs CHF 7.- to CHF 12.- (depending on the weight of the box).

Registration for a subscription is made via the website.

By registering a subscription form, the customer confirms and accepts the entirety of the general terms and conditions. In the interest of a good organization of registration for a subscription by a customer, the customer must fill out a form with his personal data in order to provide the service. The information provided to MyFeld must always be correct. The customer is responsible for the truthfulness of his personal information. In the event of incorrect information, MyFeld cannot be held liable.

MyFeld offers two types of subscriptions:

a monthly subscription for personal use or as a gift with monthly payment (5.1),
an annual subscription for personal use or as a gift with a single payment (5.2).
5.1. MONTHLY SUBSCRIPTION WITH MONTHLY PAYMENT.

The conclusion of the contract for the monthly subscription is always valid for a whole year (calendar year). By accepting this contract, the customer automatically issues a monthly direct debit authorization by credit card or pays the invoice sent to him per month upon delivery. As long as the subscription lasts (at least one calendar year), the amount will be automatically debited to the customer at the beginning of each month by credit card or he will receive a monthly invoice. The customer can cancel his monthly subscription at any time, according to the article about the cancellation of these general terms and conditions.

5.2. ANNUAL SUBSCRIPTION FOR YOUR USEFUL USE OR AS A GIFT WITH A ONE-TIME PAYMENT.

The contract for an annual subscription can be subscribed to for personal use or for third parties for a period of one year, i.e. twelve months. Payment for the subscription is due for the entire period when the contract is concluded.

6 SALES CONDITIONS FOR THE RETAIL SALE OF THE SPECIAL BOXES.

The items are limited, depending on the stock. If one of the articles is not available, the customer will be informed on the website as soon as possible.

7 NEWSLETTER SUBSCRIPTION

By agreeing to the general terms and conditions listed here while concluding a contract for a subscription or an individual order on the website, the customer MyFeld authorizes him to send emails to the email address he provided for a subscription or an individual order when concluding the contract.

You can unsubscribe from the newsletter at any time.

8 CANCELLATION / TERMINATION OF THE SUBSCRIPTION

Only the user of a monthly subscription can cancel their subscription. The user can cancel his monthly subscription at any time. To do this, he must inform MyFeld in writing by email. The cancellation / termination of the subscription will be taken into account for the next year (calendar year).

A cancellation of the subscription and a customer account can also be blocked by MyFeld according to the modalities in the relevant article “Customer account blocking”.

9 CUSTOMER ACCOUNT BLOCKING

In the event of non-compliance with the general terms and conditions, default in payment of an order, incorrect information when creating an account or possible damage contrary to the interests of MyFeld, the company reserves the right to block access to the website and the services offered or, depending on the severity of the offense to terminate the subscription and the customer account without claims for damages.

The company also reserves the right to refrain from entering into a contract with customers who have already violated the above-mentioned regulations.

10 PRICES AND PAYMENT TERMS
10.1 GENERAL TERMS OF PAYMENT FOR ALL SERVICES ON THE WEB SITE

The payments are secured using a data encryption method to prevent the interception of this data by third parties. MyFeld is not liable in the event of fraudulent use of the means of payment by third parties.

Payment with credit card:

After the order has been placed and the subscription request has been received, a request to debit the credit card is sent to the paying agent. The contract is deemed to have been concluded upon receipt of the approval of the credit card debiting from the paying agent.

Payment by invoice:

After the order has been placed and the subscription request has been received, the feasibility of “payment by invoice” is checked. MyFeld reserves the right to carry out an external credit check of the customer. If the check is negative, the customer will be informed without giving reasons for the rejection. The entire invoice amount for one year is then billed to the customer in advance payment.

According to the applicable regulations, the bank details of the members are not saved by MyFeld.

10.2 PAYMENT AND CHARGES FOR MONTHLY SHIPPING

The prices for shipping the boxes (max. Two per month) range from CHF 7.- to CHF 12.- per box (depending on the weight of the box). The deliveries are also billed to the customer. The fees can be changed. In this case, changes only apply to future orders; orders that have already been paid for will not be affected by tariff changes.

10.3. SALE PRICE AND SHIPPING FOR THE SPECIAL BOXES

The prices of the products offered are in Swiss Francs. They take into account the VAT rate valid at the time of the order. All prices are exclusive of shipping costs.

The customer receives a confirmation email of the payment after confirming the order.

10.4. Reminder / collection

Purchase by credit card: The products are paid for by credit card immediately after purchase. If the monthly subscription can no longer be charged to the credit card, the entire invoice amount for a full year is due immediately. In this case, the amount will be billed. After this payment period has expired, MyFeld reserves the right to charge reminder fees for issuing a warning about the claim. From the 1st reminder, a reminder fee of CHF 10.- and from the 2nd reminder a reminder fee of CHF 20.- will be charged. MyFeld can also assign an overdue claim to an external debt collection partner at any time. The customer can then directly invoice the customer for additional expenses and fees.

Purchase on account: The products are paid for with the invoice within 10 days net. After this payment period has expired, MyFeld reserves the right to charge reminder fees for issuing a warning about the claim. From the 1st reminder, a reminder fee of CHF 10.- and from the 2nd reminder a reminder fee of CHF 20.- will be charged. MyFeld can also assign an overdue claim to an external debt collection partner at any time. The customer can then directly invoice the customer for additional expenses and fees. After the 2nd reminder, the entire invoice amount for a whole year is due immediately.

11 PROOF

The customer acknowledges the validity and evidential value of the electronic processing and records of MyFeld, and allows these elements to have the same evidential value as a written manuscript.

12 SHIPPING
12.1. SHIPPING THE BOXES

DELIVERY AREA

The boxes will only be dispatched to the specified delivery area, specified in the “Delivery area” article, ie in Switzerland and Lichtenstein.

DELIVERY TERMS

The boxes will be delivered a maximum of two times a month to the address given when registering. In the event of a change of address, the customer must report this 15 days before the next delivery. If the delivery attempt is unsuccessful and the BOX is returned to MyFeld, another delivery attempt is made to the customer. If the package is sent to the sender again, further delivery is not possible.

SHIPPING METHOD

The dispatch takes place exclusively via the Swiss Post. Shipping to packing stations is not possible.

12.2. SHIPPING BY RETAIL SALE

The individual sale of special boxes is only possible in the selected delivery area, specified in the “DELIVERY AREA” article, ie in Switzerland and in Lichtenstein.

After receiving the confirmation email of the payment, MyFeld insures a delivery within the following two weeks. MyFeld is not liable for delays in a delivery and their possible consequences. In the event of non-delivery within two weeks of receiving the payment confirmation email, MyFeld advises you to contact customer service. If necessary, MyFeld undertakes to resend the order to the customer or to refund the customer’s money. The amount of the order and additional delivery costs are borne by the customer.

13 FORCE MAJEURE

In the event of force majeure, MyFeld is not responsible for any type of breach of contract.

The weather plays an important role in the yield. MyFeld assumes no responsibility for loss of earnings due to the influence of force majeure (such as weather, soil conditions, etc.).

14 PRODUCT CONFORMITY

The information on the website regarding the products is information from the product manufacturer. MyFeld can therefore under no circumstances be held responsible for the consequences that may arise from knowing or using this information.

15 INTELLECTUAL PROPERTY

All elements of the website, whether visual, audio, text, form, layout, illustrations, photos, documents and other elements as well as the technology behind them, are protected by copyright and trademark law. Any reproduction is strictly prohibited.

16 RIGHT OF WITHDRAWAL

In accordance with the applicable provisions of the Consumer Protection Act and within the framework of the distance selling provisions, the customer has a cancellation period of fourteen (14) days from registering for a subscription and / or validating an order. The revocation must be sent by post or email to the address given in Article 1 of these GTC. The deadline applies from the date of the order. If necessary, MyFeld will reimburse the customer for his money within the scope of exercising his right of cancellation within a maximum of thirty (30) days from the date of receipt of the notification of cancellation. The amount will be credited to the customer’s account.

17 DATA PROCESSING AND FREEDOM OF INFORMATION

The customer information requested in the questionnaire at the time of registration is necessary for the orderly handling of the order and is communicated to contractual partners of the website as part of the execution of an order. In accordance with applicable law, the customer has the right to object to the data concerning him, to access and correct this data. The customer can demand that all information be changed, supplemented, clarified or deleted that is incorrect, not up-to-date or incomplete or that its collection, use or disclosure is not permitted. In order to make use of this right, the subscriber contacts us on the website under the heading “CONTACT”.

We reserve the right to use the statistics on the information forms that the subscribers have filled out in order to optimize our service and that of our partners.

18 RESPONSIBILITY

MyFeld in its capacity as a third party is not liable for the content of the MyFeld partner sites, nor for conflicts between customers and partner sites or partner brands. Information that is used by the customer to log in, such as the user name and password, is personal and confidential. This information can only be changed at the initiative of the customer or by MyFeld, for example if the password has been forgotten. The customer is responsible for the use of his access information and must keep it secret. Any forwarding of the information on his part cannot be owed to MyFeld in any way. Every order placed with the corresponding user name and password of the customer is deemed to have been ordered by the customer. MyFeld is in no way responsible for any liability for damage

MyFeld is in no way liable for damage caused by the subscribed services, such as: general damage to reputation or image, or loss of data that may arise from the use of the services offered by MyFeld.

19 RESERVATION CLAUSE

If one or more provisions of these terms and conditions are declared to be ineffective by a law or an ordinance or a legally binding court decision, the remaining provisions shall remain in full force.

20 TRANSFER OF RIGHTS AND OBLIGATIONS

In the case of a complete or partial assignment of the business of MyFeld, the contracts between the customer and MyFeld and / or the legal successors remain binding. The contracts concluded with MyFeld cannot be transferred by the subscribers and / or the customer without the prior written consent of MyFeld. Contracts, rights and obligations of MyFeld can in any case be sold or transferred without the prior consent of the customer.

21 ADVERTISING ON THE WEBSITE

MyFeld is free to insert advertisements on the website and has freedom of choice with regard to the advertisements, their arrangement and their advertisers.

22 AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

MyFeld reserves the right to change the general terms and conditions under any circumstances. If the new general terms and conditions do not appeal to a customer, he should make use of his right of withdrawal by registered letter with acknowledgment of receipt before the new provisions come into force in accordance with the modalities in the article “Right of withdrawal” of these general terms and conditions. The refusal of the new general terms and conditions must be explicit, without express consent before the new provisions come into force, the customer automatically understands himself to be in agreement with the new conditions.

23 APPLICABLE LAW

These conditions of sale are subject to Swiss law, regardless of the customer’s country of residence and place of contract conclusion. The application of the Vienna Convention on the International Sale of Goods is expressly excluded. The subscriber acknowledges that the messages and the IT files on the website will be regarded as evidence of communications, orders, payments and other transactions between the parties, unless otherwise proven.
